GENERAL TERMS AND CONDITIONS – Cartoni Group BV

These are our terms and conditions. These, together with the references they contain, apply to any offer, quotation and agreement that we, Cartoni Group BV. (with Chamber of Commerce number: 71406336), conclude with you.

Article 1 – Products

We sell furniture (such as dining tables, chairs, sofas) through our webshop at www.cartonidesign.com, by phone and in our physical showroom at the Gustav Mahlerplein 1B in Amsterdam.

All images, specifications and other information about the products are an indication. Cartoni Group BV cannot guarantee that the colours shown exactly match the actual colours of the products.

Some products are made to measure and may therefore differ. We are not responsible for any inaccuracies on our website about designs, pictures and other information about a product.

All offers and quotations of Cartoni Group BV are without obligation. An offer consists of a description of a product and services.

Article 2 – Orders

If you place an order through the webshop, you need to fill in your details (name and address). Also when you buy from us in our showroom, you have to fill in your details. You are responsible for the accuracy of this information.

After you have placed an order, Cartoni Group BV will send you a confirmation by email.

You can change the ordered product within 24 hours after receipt of the order confirmation.

Cartoni Group BV may refuse a request for modification of a product, if this may have qualitative or quantitative consequences for the work (such as modification of a custom-made product).

Article 3 – Payments

The (total) price including VAT of the products is indicated in our webshop and physical showroom. Once products have been ordered, their prices will not be increased.

With an order you have to pay a down payment of €500,- including VAT. When you place an order by phone or e-mail, you can transfer the down payment by bank transfer. When you place an order with us in the showroom, you can pay the down payment by debit card or by bank transfer. The remaining amount can be transferred by bank transfer prior to delivery or can be withdrawn upon delivery or collection of the products. If you place an order outside the Netherlands or Belgium, you must pay the full amount prior to delivery. 

If you act on behalf of a profession or company and place a business order within the Netherlands or Belgium, you must pay 50% in advance. The remaining amount will be transferred by bank transfer after delivery. If you place an order outside the Netherlands or Belgium, you must pay the full amount prior to delivery. 

You can pay in our webshop with iDEAL, PayPal, credit card and Mister Cash.

Article 4 – Deliveries

You can have the product delivered and (depending on the product) assembled. Delivery to the ground floor in the Netherlands is free of charge, in Belgium it costs €49,- (incl. VAT). Transport and possible assembly to a higher floor is possible in consultation with the carrier, and entirely at the risk and expense of the customer. Costs for delivery to other countries are indicated per country on the website.

Ordered tables are assembled upon delivery in the Netherlands and Belgium. The other products will only be delivered. However, if you order other products besides a table that are delivered in the Netherlands or Belgium, then all products will be assembled. NOTE: wall cabinets are never assembled.

If you have a product delivered outside the Netherlands and Belgium, then products will only be delivered and not assembled.

We deliver your product to the address you gave when ordering. You can no longer change the address if we have already sent the package. JP Haarlem Delivery takes care of the distribution.

Our products are often heavy, and are therefore transported and brought in by two people if necessary. When a product is heavy, it is possible that the deliverers due to the circumstances at the delivery location can not reasonably get the product. These conditions should be optimized by you, the customer, as much as possible.

Make sure that all possible obstacles that may make it difficult to transport your goods have been removed (cabinets, paintings, lamps, etc.). Also cover vulnerable floors, walls and passageways and/or alert our driver to the vulnerability.

Cartoni Group BV is not liable for damage caused by transport from the first door/initial entrance. However, we are happy to help you to place the product inside.

You must be present during delivery, otherwise we will charge cancellation costs (€ 45, -).

If a product cannot be brought in and other means of transport (hoist or moving lift) have to be used, this is entirely at your expense and risk.

Cartoni Group BV and transport partner JP Haarlem Delivery have the right to cancel a delivery if the driver indicates that the delivery situation is irresponsible. Transport costs and any additional costs are at your expense.

Due to traffic conditions or other unexpected developments, the delivery may take place outside the given time indication.

The delivery times in the order confirmation are indicative. We do our best to deliver the order quickly. If the order is delayed, we will inform you in writing. We guarantee that you will receive the order within 150 days after confirmation of the order. If this does not work, you can ask us to (a) immediately refund the amount you have paid for the product, or (b) send you a replacement product (of equal value).

Article 5 – Change Delivery date

You can change the planned delivery date of your order via www.cartonidesign.com If you want to change the date within 24 hours before the planned delivery date, you will have to pay a cancellation fee of €45,- (incl. VAT).

Article 6 – Return

If you, as a consumer, have ordered a stock item through the webshop, you may return the product within 14 days after you have received it. You can do this by sending an e-mail to hello@cartonidesign,com. After you have received a confirmation from us, you must send the product within 14 days. Once we have received the product, we will refund the full purchase price within 14 days. The cost of returning the product will be borne by you. During the period you have to decide if you want to keep the product, you have to be careful with the product and its packaging. You may only unpack and use the product to the extent necessary to determine whether you want to keep the product. You should therefore always return the product in its original undamaged packaging. This does not apply to custom-made products as described in paragraph 2.

Products that are made to measure according to your specifications (such as the desired size and color) cannot be returned. This includes in any case the following products: dining tables, dining table benches, cushions for dining table benches, sofas, dining chairs, armchairs, wall cabinets.

Article 7 – Guarantees

Cartoni Group BV guarantees that the products comply with the usual requirements and standards that can be set at the time of delivery. Complaints about material or production faults will of course be dealt with.

You have a 12-month guarantee on products provided that all user and maintenance instructions have been followed and carried out. 

The guarantee does not apply if the product is used incorrectly.

The guarantee does not apply if a defect arises from circumstances beyond Cartoni Group BV’s control.

A lacquered or oiled tabletop may wear out as a result of normal use, this is no reason to complain. 

Excluded from the warranty are scratches in the lacquer or cracks or cracks in the panel itself. Even with normal use, a lacquered tabletop can cause scratches and cracks in the lacquer finish. This damage to the edges and surface is not covered by the warranty, as it is inherent in a lacquer finish.

A crack in a solid wood product is caused by dryness in the room where it is placed. Wood is a natural product. If it becomes too dry in the room, the wood also becomes drier and cracks. When the weather is more humid in the room, wood attracts moisture and does not tear. The relative humidity fluctuates greatly under the influence of weather, heating and insulation, for example. It is the customer’s responsibility to keep the humidity in the room where the furniture is placed at a constant level of 65%, in any case between 50% and 70%, for example by means of dehumidifiers and air dehumidifiers.

Article 8 – Reservation of title

The ownership of the products only passes to you after the full amount has been paid by you.

Article 9 – Liability

We are not liable for incorrect product information on the website or the damage caused by the use of a product. This does not apply if the damage was caused by our intent, gross negligence or wilful recklessness. Your right to compensation will in any case not exceed the amount of the ordered and paid product.

When using the product outside the Netherlands, you must verify whether the products are suitable for use in the country concerned and whether the products meet the conditions and (legal) requirements that are set.

Article 10 – Intellectual property rights

All intellectual property rights (such as: copyrights, logos, word marks) to our texts, photos, images and other materials, are our property (or are we in control with permission of the rightful owner). Your use may not violate this.

Article 11 – Force majeure

Cartoni Group BV does not have to fulfil its obligations in case of force majeure.

Cartoni Group BV may suspend its obligations under the agreement during the period of force majeure. If this period lasts longer than 3 months, both parties may dissolve the order, without being obliged to pay compensation.

Article 12 – Complaints procedure

If you have a complaint about the execution of the agreement, please let us know. Please send your complaint as soon as possible (and described as fully as possible) to hello@cartonidesign.com We will deal with your complaint as soon as possible, at the latest within five days after we have received your complaint. If it takes longer to resolve your complaint, you will receive a confirmation of your complaint within five days and we will let you know when we expect a substantive response. If we are unable to resolve the complaint among ourselves, a dispute will arise that is covered by the dispute resolution procedure. 

If it is established that an item is defective and this has been reported on time, Cartoni Group BV will replace, repair or compensate the defective item within a reasonable period of time after written notification of the defect. If you report a complaint later than 2 months after delivery, you will no longer be entitled to repair, replacement or compensation.

Article 13 – Dispute resolution

These general terms and conditions and the agreements we conclude with you are governed by Dutch law to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods. In the event of a dispute, the court in Amsterdam has jurisdiction. 

 

Delivery conditions Cartoni Group BV

Cancellation:
You can postpone the delivery of your order up to two working days before delivery free of charge. If you notify us of the change within 48 hours before delivery, we are unfortunately obliged to charge a cancellation fee (€ 45,-).

You can pick up the product in Haarlem at the address A. Hofmanweg 7, 2031 BH Haarlem or have it delivered and assemble it (depending on the product).
